These terms are a legal agreement between you and Swapaboo Ltd. They explain what we do, what you can expect from us, and what we expect from you.
Swapaboo is operated by Swapaboo Ltd, a company registered in England and Wales (company number 17463009), whose registered office is at 82a James Carter Road, Mildenhall, Bury St Edmunds, IP28 7DE.

In these terms, "we", "us" and "our" mean Swapaboo Ltd. "You" and "your" mean the person using Swapaboo.
Swapaboo is a platform where families exchange children's clothes their children have outgrown.
How it works. You photograph items your children no longer need. We assess each item's type and condition and assign it a number of credits. You can then browse items other families have listed and use your credits to claim clothes in your child's next size. The clothes are sent between families by a delivery service, and you pay a fulfilment fee for each bundle you claim.
Our role. In most cases we are an intermediary. The clothes belong to the families who list them, and when you claim a bundle you are receiving items from another family rather than from us. We are not a party to that exchange.
When we are the seller. Sometimes we list items ourselves, for example to make sure there is stock available in a size when we are starting out in a new area. Items we have listed are clearly marked as listed by Swapaboo. When you claim one of those, you are dealing directly with us, and your legal rights as a consumer apply to that item in the normal way.
You must be 18 or over and resident in the United Kingdom.
Your account is personal. Use Swapaboo for your own family, not as a business. Keep your login details to yourself, and tell us if you think someone else has access.
One account per person. We may close duplicate accounts.
What you can list. Children's clothing and related items in the categories we support, which you own and are entitled to pass on.
What you must not list. Items that are damaged, unsafe, counterfeit, soiled, or that have been recalled. Items which are not yours. Anything outside the categories we support. We may remove a listing at any time if we think it breaks these rules.
What you are telling us. When you list an item you confirm that it is yours to pass on, that it is clean, and that it has no holes, stains or heavy wear beyond anything we have identified.
How we assess items. We assess each item from the photograph you provide. Our assessment covers what is visible in that photograph. It is not an inspection, and it cannot identify faults that a photograph does not show. You remain responsible for the accuracy of what you list, including anything our assessment did not pick up.
We may reject items. If an item does not meet our condition standard we will not list it, and it will not earn credits.
You can remove a listing at any time before another family claims it. If you do, any credits that item earned are reversed.
What credits are. Credits are a unit we use to keep track of what you have contributed to the platform and what you can take from it. They are a feature of your Swapaboo account and nothing more.
Credits are earned, not bought. You earn credits by listing items. You cannot buy credits, and we do not sell them.
Credits have no monetary value. They are not money, not e-money, and not a payment instrument. They cannot be exchanged for cash, withdrawn, sold, or transferred to anyone outside Swapaboo. They are not refundable in money in any circumstances.
How credits are worked out. The number of credits an item earns depends on its type, its condition, its size, and its brand where we can identify one. We publish the general basis for this and we may adjust it from time to time. Credits already in your account are not affected by a change to how new items are valued.
When credits are awarded. You receive half an item's credits when it is listed, and the remainder when it has been sent to the family who claimed it.
Credits do not expire.
If you close your account, any unused credits are lost and nothing is payable for them.
Choosing. You choose every item you claim. Nothing is sent to you that you have not selected.
What you pay. Credits for the items, and a fulfilment fee in money for delivery or collection. The fee is shown before you confirm, and it depends on the delivery method you choose and may depend on the size of the bundle.
When the fee is taken. We authorise the fee on your card when you claim, and take it when the bundle is sent. If the bundle is not sent within 6 days, the claim is cancelled, the authorisation is released, and your credits are returned.
Starting straight away. When you claim, you are asking us to arrange fulfilment immediately rather than waiting 14 days. You confirm this when you claim, and it affects your cancellation rights as set out in section 7.
Sending. If you have listed a bundle that someone claims, you must send it within 6 days of the claim being made. If you do not, the claim will be cancelled.
You have a legal right to change your mind about the fulfilment service you buy from us, and about any item we have sold you ourselves. This section explains how that works.
You have 14 days from the day you claim a bundle to cancel the fulfilment service, without giving a reason.
But you have asked us to start immediately. Because you asked us to arrange fulfilment straight away, you can still cancel within the 14 days, and we will refund the fee in proportion to what has not yet been done. Once the bundle has been sent, the service has been performed in full and the fee is no longer refundable.
If you cancel before the bundle is sent, we refund the fee in full and return your credits.
Where an item was listed by Swapaboo rather than by another family, you are buying goods from us and you have the full statutory right to cancel.
You have 14 days from the day you receive the item to tell us you are cancelling, and a further 14 days to return it. We will refund what you paid, including the standard fulfilment fee, within 14 days of getting the item back or of you showing us it has been sent.
You pay the cost of returning it, unless the item was faulty or not as described.
These are not sold by us, so the statutory cancellation right does not apply to them. What applies instead is the arrangement in section 8: tell us within 14 days if something is significantly not as described and we will return your credits.
Email hello@swapaboo.com, or use the cancellation form at the end of these terms. Any clear statement that you are cancelling is enough. We will confirm and refund within 14 days.
Tell us within 14 days of receiving a bundle if an item is significantly different from how it was described or shown.
What we will do. If we agree, we will return the credits you spent on that item and refund the fulfilment fee where the whole bundle was affected. We may ask for photographs.
Items listed by other families. Because the exchange is between you and another family, your rights over the item itself are against them rather than us. What we provide is the credit return above, which we offer as part of our service.
Items listed by Swapaboo. Where we listed the item, your statutory rights apply in full and nothing in these terms limits them.
What we charge. A fulfilment fee for each bundle claimed. Current fees are always shown before you confirm a claim.
Fees may change, and may vary by delivery method, bundle size, or location. Changes apply to claims made after the change, never retrospectively.
Other paid services. We may introduce other optional paid services in future. Anything new will be optional, clearly priced, and explained before you use it. We will never charge you for something without telling you first.
Your photographs. You keep ownership of the photographs you upload. You give us permission to use them to operate Swapaboo, including showing them to families browsing items, and to improve how we assess items.
Photographs should show the item, not people. Lay items flat where you can. Please do not upload photographs of children.
What we are always responsible for. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else which the law does not allow us to limit.
What we do not promise. Swapaboo depends on what other families list, so we cannot promise that particular items or sizes will be available.
Our assessment. We assess items from photographs and we take that seriously, but we cannot guarantee that an assessment is complete or that an item is free of faults a photograph does not show.
Our limit. Other than the things above, and other than your statutory rights in respect of items we have sold you, our liability to you in connection with a bundle is limited to the fulfilment fee you paid for it together with the return of the credits you spent. Nothing here limits any remedy the law gives you that cannot be limited.
This does not affect your statutory rights.
You can close your account at any time. Unused credits are lost.
We may suspend or close an account if these terms are broken, if we think an account is being used dishonestly, or if we are required to. Where we reasonably can, we will tell you why and give you the chance to put it right.
We may change these terms where there is a good reason: a change in the law, a change in how Swapaboo works, the introduction of a new feature, or to make something clearer.
We will tell you at least 30 days beforehand by email if a change affects you materially, and explain what has changed and why. If you do not agree, you can close your account and we will not apply the change to you before it takes effect.
Changes that are purely in your favour, or required immediately by law, may take effect sooner.
Governing law. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you can also bring proceedings there.
Transfer. We may transfer our rights and obligations under these terms to another organisation, and we will tell you if we do. You cannot transfer yours.
No partnership. These terms do not make us partners or agents of one another.
If part of these terms cannot be enforced, the rest still applies.
Complaints. Email hello@swapaboo.com. We aim to respond within five working days and to resolve things within 14 days. If you are not happy with how we have dealt with a complaint, you can contact Citizens Advice on 0808 223 1133 or at citizensadvice.org.uk, who can advise on your options.
You only need to use this if you want to. An email saying you are cancelling is enough.
